EPR - When is this mandatory requirement?

Extended Producer Responsibility (EPR) can be confusing. Regulations and requirements are constantly evolving, making it difficult to stay compliant. Expandly is here to simplify the process and remove the stress.

In this guide, we explain EPR requirements by country and outline when registration becomes mandatory.

UK (holding stock domestically)

Registration not required if:

  • Annual turnover is below £1 millionand

  • You handle less than 25 tonnes of packaging per year.

Germany (holding stock domestically)

  1. EPR, WEEE, and Batteries registration is mandatory from day one
  2. No sales or volume thresholds apply.
  3. Single-use plastics are always in scope, regardless of volume

France (holding stock domestically)

  1. EPR, WEEE, and Batteries registration is mandatory from day one, regardless of sales or volumes.
  2. Additional EPR categories also requiring registration, include:
    - Textiles
    - Furniture
    - DIY products
    - Toys
    - Chemicals
    - Food service packaging
    - Sports & leisure equipment
    - Medical and piercing equipment

Spain

  1. EPR and WEEE/Batteries registration is required from day one
  2. Applies whether goods are:
    - Stored in Spain, or
    -Fulfilled into Spain from another country.

Italy

  1. WEEE and Batteries registration is required from day one
  2. Applies whether goods are:
    -Stored in Italy, or
    -Fulfilled into Italy from another country.

Belgium

  1. EPR and WEEE/Batteries registration is required from day one
  2. Applies whether goods are:
    -Stored in Belgium, or
    -Fulfilled into Belgium from another country.

Netherlands (holding stock domestically but in a 3PL)

  1. Packaging EPR threshold: 50,000 kg of packaging waste per year
    - Registration required once this threshold is exceeded.
  2. No thresholds apply for:
    - Batteries
    - WEEE
    - Textiles
  3. These categories require registration from day one.
  4. Single-use plastics are always in scope, regardless of volume

Poland

  1. EPR registration is required regardless of sales volume or product origin
  2. Authorized Representative required for WEEE and Batteries.

Sweden

  1. EPR and WEEE/Batteries registration is required from day one
  2. Applies whether goods are:
    - Stored domestically, or
    - Fulfilled into Sweden from another country.

Austria

  1. EPR and WEEE/Batteries registration is required from day one
  2. Single-use plastics are always in scope, regardless of volume

Ireland

  1. WEEE and Batteries registration is required from day one
